R v Chen—Rethinking Sentencing Principles in Cruelty Cases

The case of R v Chen offers a rare opportunity for appellate guidance on how courts should apply Criminal Code sentencing principles in animal cruelty cases. Animal Justice intervened in the case to make submissions about how courts can best respect animals' interests in these cases. This presentation will elaborate on why animals are best served by a broader emphasis than simply general deterrence and denunciation—typically delivered in the form of lengthy jail sentences. Rather, recognizing harm done to animals by these offences requires a focus on reparations, rehabilitation, and the prevention of future harm.
